Guidelines for Ethical Medicine Sales

Issued February 15, 2025
To uphold public trust and legal standards, MCDA mandates:

  1. Prescription Adherence: Sell Schedule H and H1 drugs only with a valid prescription from a registered medical practitioner. Over-the-counter (OTC) sales must align with the Drugs and Cosmetics Rules, 1945.
  2. No Substitutes Without Consent: Do not substitute branded medicines with generics unless approved by the customer or prescriber.
  3. Pricing Transparency: Display MRP on all products; discounts must not violate fair trade norms.
  4. Record Keeping: Maintain digital or physical sales records for 3 years, accessible for MCDA or Drug Inspector audits.
  5. Customer Education: Inform patients about proper dosage and storage when dispensing.
Violations may lead to fines up to ₹5,000 or membership review. Report unethical practices to ethics@mcda.org.
